In submitting any and all comments, statements, stories, ideas, content, data, photographs, videotape, audio tape and/or other recordings or media (hereafter, “Submissions”) to Jobs Growth Freedom Fund (hereafter, “JGFF”), I grant JGFF and its successors a perpetual, irrevocable, worldwide, sublicensable (through multiple tiers), royalty-free and transferable license (with a right to create derivative works) to publish, reproduce, distribute, publicly display, edit, modify, create derivative works of and otherwise use the Submissions in any manner or media and for any purpose whatsoever at the sole discretion of JGFF, without limitation to any political, advertising or commercial use of any kind. I further give my permission to use my name, likeness, voice, and biographical information in connection with such Submissions and release JGFF and anyone acting under its authorization from any claims that any use of the Submissions as authorized herein violates any of my rights, including any rights of publicity or privacy.
By default, all Submissions published are public, and by providing JGFF with Submissions, it is published so that anyone can view it. Any Submissions you provide to JGFF will be deemed public information and not subject to any confidentiality obligation and JGFF shall have no obligation to maintain its confidentiality. Submissions published are accessible to everyone, including via search engines, and you may lose any privacy rights you might have regarding that content. In addition, Submissions shared publicly may be copied and shared throughout the Internet.
In regards to creating the Submissions, I concede that I was volunteering my time to JGFF and that any disposable materials used in the creation of the Submissions may constitute an in-kind donation to JGFF. I agree to defend, indemnify and hold JGFF, and any candidates or other persons affiliated therewith, harmless from and against any liabilities, losses, claims, demands, costs and expenses (including reasonable attorneys’ fees) arising out of or in connection with the use of the Submissions or of my name, likeness, voice, or persona, or from the breach or alleged breach of any of the foregoing representations or warranties.
By making Submissions, I further understand that I waive the right to make any claim against JGFF or any of its respective parents, subsidiaries, affiliates, successors, assigns, employees, agents, directors or officers related to the Submissions, including, but not limited to, unfair competition, invasion of privacy, negligence, breach of implied contract or breach of confidentiality, and I further waive all moral rights I may have in any materials uploaded or sent to JGFF. I represent and warrant that my Submissions: (a) shall be true, accurate, current, complete and not misleading, (b) shall not violate the rights of any third party, including, but not limited to, intellectual property and proprietary rights, (c) shall not be fraudulent or involve counterfeit or stolen information or items, (d) shall not violate any law, statute, ordinance or regulation, and (e) shall not create any liability for JGFF or any of its respective parents, subsidiaries, affiliates, successors, assigns, employees, agents, directors and officers. I also agree to maintain and promptly update your Submissions in order to keep that information true, accurate, current and complete.
I further represent and warrant that (i) I own or have the necessary licenses, rights, consents and permissions to use and authorize Connected Ventures to use all patent, trademark, trade secret, copyright or other proprietary rights in and to my Submissions to enable inclusion and use of the Submissions in the manner contemplated by this Agreement; and (ii) I have any necessary written or implied consent, release, and/or permission of each and every identifiable individual person in the Submissions to use the name, picture and likeness of each and every such identifiable individual person to enable inclusion and use of the Submissions in the manner contemplated by this Agreement.
I understand and agree that I will not be entitled to any compensation for the rights and release granted herein or for any use of the Submissions and that JGFF shall have no obligation to make any use of the Submissions.
